The Andalucía High Court of Justice, TSJA, has given an second reminder to the Environment Council of the Junta de Andalucía for them to modify the norms and concede the maximum level of environmental protection to Algarrobico, situated in the Cabo de Gata-NIjar Nature Park in Almería province. The court has clearly called on the Junta to place the park in the highest level of protection under the PORN Natural Resources Ordination Plan of 1994. That means it is a fully protected space and cannot be built upon. It means that constructions such as the Hotel in Algarrobo could not be constructed, and the current structure which is 90% complete is pending a judicial review. The Junta says that it wants to respond to the High Court but it notes the existence of a protocol from November 2011 with the Minister for the hotel’s demolition and the recovery of the land, and this will happen if a judicial order arrives.
